Terms of Service
Effective date: Immediately. These terms govern your access to and use of CGT Strategist and all related services.
1. Agreement to terms
By accessing or using CGT Strategist, you agree to be bound by these Terms of Service. If you do not agree, you must not use the service.
2. Nature of the service
CGT Strategist is a calculation and record-keeping tool designed to assist with modelling capital gains tax results. It does not provide financial, tax, or legal advice and is not a substitute for advice from a registered tax agent or accountant.
You are solely responsible for verifying all results against your own records and for how you use any outputs generated by the service.
3. Payments and refunds
Certain features, including access to Evidence Pack report generation for a specific workspace and financial year, require payment. Access to paid features is granted immediately after successful payment.
Due to the digital nature of the service and immediate access being provided, purchases are generally non-refundable, including in cases of change of mind or dissatisfaction based on your own data inputs.
If a technical fault in the service prevents report generation, we will make reasonable efforts to resolve the issue or restore access. Nothing in this section limits your rights under Australian Consumer Law.
4. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must ensure that all information you provide is accurate and complete.
5. Data use licence
You grant us the right to process your data only to provide, secure, maintain, and improve the service.
We do not sell or trade identifiable user investment data.
6. Acceptable use
You must not misuse the service, interfere with its operation, attempt unauthorised access, or use the service in violation of any laws. We may suspend or terminate access if misuse is detected.
7. Intellectual property
All software, designs, and content forming part of CGT Strategist are owned by us or our licensors and are protected by law. You may not copy, reverse engineer, or redistribute any part of the service.
8. Third-party services
The service may rely on third-party infrastructure or data sources. We are not responsible for third-party services or their availability.
9. Disclaimers
The service is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee that calculations will be error-free or suitable for any particular purpose.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, including tax results, penalties, lost profits, or reliance on generated reports.
Our total liability is limited to the amount you paid us for the service in the previous 12 months.
11. Indemnity
You agree to indemnify and hold us harmless from any claims arising from your use of the service, your data, or your breach of these terms.
12. Termination
We may suspend or terminate access if you breach these terms or if required for operational or legal reasons. Upon termination, your right to use the service ends.
13. Governing law
These terms are governed by the laws of Australia, and disputes are subject to the jurisdiction of Australian courts.
14. Changes to these terms
We may update these terms from time to time. Continued use of the service after updates means you accept the revised terms.
